Richard Gwynne


Richard has long experience in resolving a very wide range of complex commercial disputes, most of which have a cross border dimension. This may be through litigation, arbitration or ADR or old fashioned negotiation.

Richard's experience includes working on matters concerning banking and finance looking at derivative disputes, transactional issues, trade finance and significant recovery actions including claims against third parties; shareholder, joint venture and investor oppression issues; and cross border disputes, managing litigation across numerous jurisdictions.

His recent work includes acting for SPL Guernsey in various claim against investment managers, former directors and auditors arising out of the Arch Cru affair. Richard has also acted in a high profile LIBOR dispute arising out of a substantial multi party international financing (including a derivative) which is one of the lead cases on this issue.

Richard has written and spoken frequently, in particular on cross border issues and trade finance matters.

He is a member of the ICC UK Committee on Banking Technique and Practice and was also a member of an ICC working party on the use of a-national dispute resolution provisions in international contracts. He also acted with ICC UK on particular concerns arising out of the negotiations for the entry into the Rome I Regulation.

He is now focussing on the implications of Brexit for dispute resolution issues, in particular jurisdiction and the enforcement of judgments.
